In the state of Minnesota, there are two forms of expungement. Currently, there is statutory authority expungement and inherent authority expungement. The crucial differences between the two types of expungements are how the kinds of records that are sealed. Inherent authority expungement is normally only available through the court.
- Statutory authority expungement focuses on five kinds of cases which can be expunged:
- Juvenile offenses that are prosecuted in juvenile court
- Juvenile offenses which are prosecuted in adult court
- In instances where there is not a guilty plea or conviction. This can involve pardoned cases, vacated and dismissed cases.
- Felony drug offenses that have been dismissed following the successful completion
- An offense prior to 1977 that involved a small amount of marijuana
